Efforts to modernise Island's legal framework underway
New legislation to protect individuals who may lack the capacity to make decisions for themselves is set to move a step nearer.
An implementation plan for the Capacity Act 2023 sets out how the changes will be brought in and a timetable to bring the act into force.
It aims to safeguard the rights, dignity and wellbeing of those who may be at risk with work to bring the final act into force expected to be completed by the end of this year.
The new act is designed to provide flexibility in its protections and application acknowledging the situations that can lead to impairment of capacity.
These may include disabilities, learning difficulties, mental health problems, strokes, head injuries or the onset of dementia.
The presence of such legislation would bring the Isle of Man into line with the UK where similar provisions already exist.
Minister for Health and Social Care Claire Christian said: “The act is the result of our commitment to modernise the Island’s legal framework.
“It will ensure people are at the heart of the decision-making process by supporting them to make their own decisions on everyday matters such as health and welfare, property and financial affairs.
“We want to empower people to make decisions for themselves wherever possible and protect people who lack capacity by providing a flexible forward-looking framework.”
